Service objective

The purpose of these terms is to regulate the Pointree service provided by PointreeLLC, registered in Newark, Delaware United States

Pointree Services consist of the deployment of Infrastructure or Software as a Service, aimed at providing companies access to the latest technology in Cloud Computing services for Telecommunications

Purpose of the services

Pointree Services are provided on a Cloud Computing infrastructure, also known as cloud computing, which involves offering infrastructure and software as a service. This allows you to access services and utilize highly complex systems and infrastructures without needing extensive knowledge of resource management, such as system development, servers, networks, communications, security, etc

The Services provide companies with access to solutions for every business need and are offered through platforms hosted by top cloud providers such as Google, Amazon, or proprietary platforms, which manage workloads and their growth

Software as a service

All the platform software or the Services offered have been developed and are the intellectual property of Pointree.
Pointree grants a user license that allows you to use the software as part of the Services. You may not copy, modify, distribute, sell, or lend any part of our Services or the included software, nor may you apply reverse engineering techniques or attempt to extract the source code of said software

Use of our service

You must not use our Services improperly, interfere with those Services, or attempt to access them using a method other than the user interface or API provided by Pointree. You may only use the Services to the extent permitted by law.

Pointree may suspend or terminate the Service if you do not comply with our policies or terms, or if we believe that your conduct may be malicious. Your use of our Services does not grant you ownership of any intellectual property rights therein.

Pointree is constantly changing and improving its Services. Therefore, we may add or remove certain functions or features

Payment for use of services

Invoices for the payment of Services are generated on the first day of the following monthly period and are sent to the email address of the primary contact. This email contains the precise instructions for making the corresponding payment

Duration and cancellation of services

You can stop using the Services at any time
To terminate your service, you must deactivate your account from the control panel of the associated Service or contact us via email or phone

Service suspension

Pointree may suspend the Service after the due date for payment of your usage invoices
Accounts with outstanding payments are automatically suspended after 30 days from the issuance of the payment
Pointree will automatically notify via email every 7 days about outstanding payments
Accounts with outstanding payments are automatically terminated after 60 days from the payment due date and no response from the user
If we terminate your Service, we will notify you in advance and allow you to extract your information from the Service

Update of conditions

We may modify these Service conditions to reflect changes in Service features, regulations, or laws. You should periodically review the conditions on our website: www.pointree.com/terms-and-conditions
Pointree may make modifications to the business conditions due to situations beyond Pointree's control, such as exponential increases in the costs of necessary supplies for providing the service, natural disasters, or wars
If you do not accept the modified conditions for a Service, you should cancel your use of that Service..
In the event of any conflict, the new conditions will prevail concerning that conflict
These conditions govern the relationship between Pointree and you, and they do not create any rights in favor of third parties
If you fail to comply with these conditions, and we do not take immediate action, it does not imply a waiver of any right to take action in the future.

Liability for our services

To the extent permitted by law, Pointree shall not be liable for lost profits, loss of data, or financial losses, nor for indirect damages.
To the extent permitted by law, Pointree's total liability for any claims under these conditions, including any implied warranties, shall be limited to the amount you paid to use the services on a monthly basis.
In no event shall Pointree be liable for losses or damages that are not reasonably foreseeable by you
